The Animals and Animal Products (Import and Export) (England and Wales) (Amendment) (Wales) Regulations 2002

  Made 26th February 2002 
  Coming into force 27th February 2002 

The National Assembly for Wales being designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on it by that section, and of all other powers enabling it in that behalf, makes the following Regulations - 

Title, application and commencement
     1.  - (1) These Regulations are called the Animals and Animal Products (Import and Export) (England and Wales) (Amendment) (Wales) Regulations 2002.

    (2) These Regulations apply to Wales.

    (3) These Regulations come into force on 27th February 2002.

Amendment of the Animals and Animal Products (Import and Export) (England and Wales) Regulations 2000
    
2.  - (1) The Animals and Animal Products (Import and Export) (England and Wales) Regulations 2000[3] are amended in relation to Wales in accordance with the following provisions of this regulation.

    (2) In regulation 12 - 

    (a) in paragraph (2) after the words "Council Directive 64/432/EEC" there shall be added the words "and is satisfied that the operator of the assembly centre has agreed to comply with the requirements for the operation of the centre which an inspector has specified in an operational agreement as being the requirements the inspector believes are necessary to ensure the centre is capable of being operated in accordance with the second indent of paragraph 3(2) of Council Directive 90/425/EEC"; and

    (b) in paragraph (3), after the words "cattle or pigs" there shall be inserted the words "or sheep or goats".

    (3) In Schedule 3, Part I, paragraph 9, after the words "Commission Decision 97/315/EC (OJ No. L137, 28.5.97, p. 20);" there shall be inserted the following - 

           " Commission Decision 2001/327/EC (OJ No. L115, 25.4.2001, p. 12), as amended by Decisions 2001/349/EC (OJ No. L123, 04/05/2001, p.26), 2001/378/EC (OJ No. L132, 15/05/2001, p. 31), 2001/394/EC (OJ No. L138, 22/05/2001, p. 36), 2001/416/EC (OJ No. L149, 02/06/2001, p. 40), 2001/448/EC (OJ No. L176, 29/06/2001, p. 75), 2001/709/EC (OJ No. L261, 29/09/2001, p. 69), 2001/904/EC (OJ No. L335, 19.12.2001, p. 21) and 2002/153/EC (OJ No. L50, 21.2.2002, p. 98);".

    (4) In Schedule 3, Part I after paragraph 15 there shall be added the following paragraph -

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations, which come into force on 27th February 2002, amend the Animals and Animal Products (Import and Export) (England and Wales) Regulations 2000 (S.I. 2000/1673) to make provision in relation to Wales to give effect to - 

  • article 4 of Commission Decision 2002/153/EC (OJ No. L50, 21.2.2002, p.98), concerning certain protection measures with regard to foot-and-mouth disease in the United Kingdom, repealing Decision 2001/740/EC and amending for the eighth time Decision 2001/327/EC; and

  • Commission Decision 2001/327/EC concerning restrictions to the movement of animals of susceptible species with regard to foot-and-mouth disease (OJ No. L115, 25.4.2001, p. 12).

A Regulatory Appraisal has not been prepared for these Regulations.
